General Terms and Conditions of Sale

Scope of Application
1.1 These General Terms and Conditions of Sale (“GTC”) apply to all transactions between Starado Sagl (the “Seller”) and its customers (the “Customer”) for the purchase of products via the website swissrares.ch.

Orders
2.1 The Customer may submit orders through the Website.
2.2 Every order is considered a purchase offer for the products listed in said order.
2.3 The Seller reserves the right to decline any order at its discretion, including but not limited to cases where the product is out of stock, the payment information is invalid, or the Customer fails to comply with these GTC.

Prices and Payment
3.1 Product prices are indicated in Swiss francs (CHF) and include Swiss VAT.
3.2 Payment may be made through the methods offered on the Website.
3.3 The full payment must be received before the products are shipped or made available for in-store collection.

Delivery
4.1 Stated delivery times are estimates and are not guaranteed.
4.2 The Seller strives to ensure prompt delivery but cannot be held responsible for delays arising from circumstances beyond its control.

Right of Withdrawal
5.1 Under Swiss consumer protection law, the Customer has the right to cancel a purchase within 14 days from receiving the products.
5.2 To exercise this right, the Customer must notify the Seller in writing before the end of the withdrawal period and return the products in their original, unused condition and packaging, at their own expense. Shipping costs are non-refundable. If a refund is issued, return shipping costs will be deducted from the total.
5.3 The refund will be processed within 14 days of the Seller’s receipt of the returned products, provided they comply with the conditions mentioned.
5.4 To return a product, please mail it to: Starado Sagl, Via Muron 20, 6780 Airolo, Switzerland.

Liability for any supplementary costs incurred by a customer caused by a delayed / lost / misrouted orders

Returns And Cancellation Policy:

The buyer will be responsible for the postage costs and ensuring any returned items arrive to us in the same condition they were purchased in. If your item does not meet the standards it was sent in, Swiss Rares has the right to refuse refund. You will be notified of this decision by Swiss Rares.

If your item is unopened, unused, undamaged and in its original state you received it- you can return your product to us up to 14 days after you received deliver of it.

If you have taken receipt of damaged or faulty items please inform us as soon as possible. You have 14 days from the date of receiving the item to notify us for a suitable resolution. Please note Swiss Rares may ask for proof of damaged or faulty items. Swiss Rares reserve the right to refuse returns if you cannot provide us with accurate information or issues arise after this period.

If you have received a packaged product and the cards inside are faulty Swiss Rares are not liable for this. Please contact the manufacturer to dispute this.

Refunds will be processed no later than 30 days after we receive your items.

If you need to cancel an order you have already placed you are intitled to a full refund up until the order has been shipped. If your order has been sent out you will have to return the item back to us in undamaged and unopened. Swiss Rares will issue you a full refund. Please note postage is paid by the buyer.

You have the right to amend any order you have already placed with Swiss Rares up until the moment the order has been dispatched. Please contact us via email to discuss changes to your order.

Delivery and Courier:

Swiss Rares use Swiss Post or DHL for sending packages. We aim to get every order placed before 16:00 dispatched the same day. Please note orders will be send Monday-Friday. On some occasions the courier may fail to deliver your item on time, if this happens please contact us and we will contact our courier to find out where your item is. If your item has been lost in the post, Swiss Rares will provide you with a refund for your item or replacement item. Swiss Rares cannot be held responsible if the courier is late.

Swiss Rares have the right to change their delivery prices if postage prices by courier fluctuate. This will not apply to orders already placed.

6.3 The warranty does not cover damage caused by improper use, neglect, or normal wear and tear.

Liability
7.1 To the extent permitted by law, the Seller shall not be held liable for any direct, indirect, special, or consequential damages resulting from the use or the inability to use the purchased products.

7.2 While we strive to ensure timely and accurate delivery of all orders, Swiss Rares shall not be held liable for any supplementary costs incurred by customers due to delays, lost shipments, or misrouted orders caused by third-party couriers or unforeseen circumstances. We recommend reaching out to our customer service team for assistance with tracking or resolving shipping issues. In the event of a lost or delayed order, we will work diligently with our courier partners to investigate and provide appropriate resolutions, such as replacements or refunds, where applicable.

Applicable Law and Jurisdiction
8.1 These GTC are governed by Swiss law.
8.2 Any dispute in connection with these GTC shall be submitted to the exclusive jurisdiction of the courts of Faido, Switzerland, or anyways in the canton of Ticino.

Amendments to the General Terms and Conditions of Sale
9.1 The Seller may modify these GTC at any time. Any changes will be posted on the Website and will apply to orders placed after the publication date.

Customs Fees and VAT for International Orders
10.1 Customers placing orders from outside Switzerland are responsible for all customs fees, taxes, import duties, and similar charges imposed by their local authorities.
10.2 The Seller cannot anticipate or influence these fees and cannot be held liable for them.
10.3 By placing an international order, the Customer acknowledges and accepts responsibility for all related customs duties and taxes.
