General Terms and Conditions of Sale

Scope of Application

1.1 These General Terms and Conditions of Sale ("GTC") apply to all transactions between Starado Sagl (the "Seller") and its customers (the "Customer") for the purchase of products via the website swissrares.ch.

Orders

2.1 The Customer may submit orders through the Website. 2.2 Every order is considered a purchase offer for the products listed in said order. 2.3 The Seller reserves the right to decline any order at its discretion, including but not limited to cases where the product is out of stock, the payment information is invalid, or the Customer fails to comply with these GTC.

Prices and Payment

3.1 Product prices are indicated in Swiss francs (CHF) and are displayed excluding VAT. For orders shipped to Switzerland, the applicable Swiss VAT will be calculated and added at checkout. For orders shipped outside Switzerland, no Swiss VAT is charged. 3.2 Payment may be made through the methods offered on the Website. 3.3 The full payment must be received before the products are shipped or made available for in-store collection.

Delivery

4.1 Stated delivery times are estimates and are not guaranteed. 4.2 The Seller strives to ensure prompt delivery but cannot be held responsible for delays arising from circumstances beyond its control.

Right of Withdrawal

5.1 Under Swiss consumer protection law, the Customer has the right to cancel a purchase within 14 days from receiving the products. 5.2 To exercise this right, the Customer must notify the Seller in writing before the end of the withdrawal period and return the products in their original, unused condition and packaging, at their own expense. Shipping costs are non-refundable. If a refund is issued, return shipping costs will be deducted from the total. We will also deduct any transaction fee that we had to sustain as these fees are not refunded by the payment provider in any case. 5.3 The refund will be processed within 14 days of the Seller's receipt of the returned products, provided they comply with the conditions mentioned. 5.4 To return a product, please mail it to: Starado Sagl Via Muron 20 6780 Airolo, Switzerland

Returns and Cancellation Policy

The buyer will be responsible for the postage costs and ensuring any returned items arrive to us in the same condition they were purchased in. If your item does not meet the standards it was sent in, Swiss Rares has the right to refuse a refund. You will be notified of this decision by Swiss Rares.

If your item is unopened, unused, undamaged and in its original state, you can return it to us up to 14 days after delivery.

If you receive damaged or faulty items, please inform us as soon as possible. You have 14 days from the date of receiving the item to notify us for a suitable resolution. Swiss Rares may ask for proof of damaged or faulty items. We reserve the right to refuse returns if you cannot provide us with accurate information or if issues arise after this period.

If you receive a sealed product and the cards inside are faulty, Swiss Rares is not liable. Please contact the manufacturer directly.

Refunds will be processed no later than 30 days after we receive your items.

You are entitled to a full refund for order cancellations until the order has been shipped. If the order has already been dispatched, you must return it to us in unopened and undamaged condition. Swiss Rares will issue a full refund once the return is received. Return shipping is at the buyer's expense.

You have the right to amend any order up until it is dispatched. Please contact us via email to make changes.

Delivery and Courier

Swiss Rares uses Swiss Post or DHL/FEDEX/UPS to send packages. Orders placed before 16:00 will usually be dispatched the same day, Monday through Friday. Occasionally, the courier may fail to deliver your item on time. If this happens, please contact us and we will contact the courier. If your item is lost in the post, Swiss Rares will provide a refund or a replacement. Swiss Rares cannot be held responsible for courier delays.

Swiss Rares reserves the right to change delivery prices if courier rates fluctuate. This does not apply to orders already placed.

Swiss Rares works diligently to keep all information and pricing accurate. However, errors may occasionally occur. In such cases, Swiss Rares reserves the right to refuse or cancel orders with incorrect information or pricing. You will be contacted if your order is affected.

Warranty

6.1 The Seller guarantees that the products are free from manufacturing defects and conform to their description upon delivery. 6.2 The Customer must inspect the products upon receipt and promptly report any defects or discrepancies. 6.3 The warranty does not cover damage caused by improper use, neglect, or normal wear and tear.

Liability

7.1 To the extent permitted by law, the Seller shall not be held liable for any direct, indirect, special, or consequential damages resulting from the use or inability to use the purchased products. 7.2 While we strive to ensure timely and accurate delivery of all orders, Swiss Rares shall not be held liable for any supplementary costs incurred by customers due to delays, lost shipments, or misrouted orders caused by third-party couriers or unforeseen circumstances. We recommend contacting customer service for assistance. In case of a lost or delayed order, we will work with the courier to investigate and provide appropriate resolutions such as replacements or refunds where applicable.

Applicable Law and Jurisdiction

8.1 These GTC are governed by Swiss law. 8.2 Any dispute in connection with these GTC shall be submitted to the exclusive jurisdiction of the courts of Faido, Switzerland, or otherwise within the canton of Ticino.

Amendments to the General Terms and Conditions of Sale

9.1 The Seller may modify these GTC at any time. Changes will be published on the Website and apply to orders placed after publication.

Customs Fees and VAT for International Orders

10.1 Customers outside Switzerland are responsible for all customs fees, taxes, import duties, and similar charges imposed by their local authorities. 10.2 The Seller cannot anticipate or influence these fees and is not liable for them. 10.3 By placing an international order, the Customer acknowledges and accepts responsibility for all related customs duties and taxes.
